Problem: Subcontractors do not adequately preserve their lien rights, thereby eliminating a powerful tool for getting paid on problem projects.
Many of our clients are not serving notices properly, while others are not serving notices at all. Additionally, there are several common myths in the industry that subcontractors rely upon and thus fail to adequately protect themselves. One such myth is that the Sub has his lien rights protected after asking the Contractor in writing for a copy of the Notice of Commencement (NOC). WRONG!
In the current economic climate such protection is more important than ever. Everyone needs to preserve lien rights the right way from the beginning of each and every job.
The failure to properly serve Notices of Furnishing happens so often to our clients that we have decided to find a way to help.
Solution: The Decker Vonau Mechanics’ Lien Subscription Service
The Decker Vonau Mechanics’ Lien Subscription Service is an essential service to participating subcontractors and material suppliers. We will look for and provide Notices of Commencement, and will provide other services to participants on a fixed fee basis. The Subscription Service will be a limited representation outside of the normal representation of clients by the law firm. In other words, a participant may subscribe to the service, but still use other attorneys for their legal dispute/Mechanics’ Lien work or other legal needs.

- All fees, subscription or otherwise will be charged to the participant and paid via credit card.
- Subscribers will receive and electronic information form to use when making a request.
- Participants will send us information they find in Dodge Reports and plan related information when they are bidding projects or shortly thereafter.
- Email will be used to transmit information to and from a subscriber. Requests will not be received by way of normal mail. Faxes will be permitted when the client does not have email.
- All requests for NOC searches and additional services will be sent to lienservice@dvslv.com. The electronic form will have and embedded email address.
- We will search for NOC’s or request NOC’s from an owner upon receiving a request, hopefully while the project is at the bid stage or just beginning, and keep our results on file so that the NOC or other information is available to subscribers as needed.
- Other non-participant clients will still be entitled to the information in our files, but they will pay for the information and services on an hourly rate basis.
- We cannot guaranty that we will find an NOC for every project.
- Participants will have peace of mind by having these services provided by a Firm with decades of experience in the complicated field of mechanics’ lien law as inexpensively as possible.
- The service is limited to construction projects in Ohio. This service will not apply to Projects owned by the Federal Government.
